This User Agreement (hereinafter referred to as the “Agreement”):

This Agreement has been established and entered into between ERA AUTO d.o.o (“Era Auto”) and the persons (hereinafter referred to as “Member” or “User”) who wish to become a member of the website provided below and benefit from car rental services, upon completing the membership process on the website www.flamingo.ba and when the membership process is registered in EraAuto’s records.

EraAuto provides users with intermediary reservation services for car rentals through the website www.flamingo.ba and EraAuto Mobile Applications, which it operates as a service provider. It serves as an intermediary service provider for the establishment of a “car rental agreement” and/or reservation through the website www.flamingo.ba and EraAuto Mobile Applications between the Service Receiver and the Car Lessor. It offers users the opportunity to list, filter, and compare vehicles from various third-party car rental companies (the lessors/operators), based on certain criteria. Since EraAuto is an intermediary service provider in car rental services, the Service Receiver is required to be a member of the website and comply with the site’s terms of use for the service to be complete and flawless.

In this Agreement, which determines the mutual rights and obligations of the parties, the website refers to the online platform that enables Members to access car rental services by registering on the websit www.flamingo.ba using internet-connected computers and other electronic/mobile devices.

By accessing the site, the Member is deemed to have accepted the membership terms and the rules of this Agreement. Furthermore, the Member declares, accepts, and undertakes that they have read and fully understood the entirety of this Agreement, have electronically approved its provisions, completed the membership process, and that the “Privacy and Cookie Policy” and “Clarification Text” on the mentioned website are integral parts and annexes of this Agreement; they will comply with the declarations regarding the membership services provided by EraAuto on the site.

DEFINITIONS

Vehicle: Vehicles that can be rented by Members in exchange for the price listed in third-party advertisements provided on the EraAuto website for rental purposes.

Website: The website www.flamingo.ba, which serves EraAuto users.

User/Member: Individuals and/or legal entities who register on the website and begin receiving services.

Service: The exhibition of vehicles owned by third-party car rental companies on the website www.flamingo.ba and the EraAuto Mobile Application, the establishment of necessary communication/payment infrastructure for renting vehicles, the facilitation of the establishment of a “car rental agreement” between the User and third-party car rental companies, and the transmission of the user’s reservation to the car rental company.

Personal Data: Any information relating to an identified or identifiable natural person.

Processing of Personal Data: The collection, recording, storage, modification, disclosure, transmission, or deletion of personal data through automated or non-automated means, either wholly or partially, as part of a data record system.

Agreement: This text containing the Membership Terms and the Privacy and Cookie Policy and Clarification Text, which are inseparable parts of this document.

Site: The website located at www.flamingo.ba.

Mobile Applications: The EraAuto application designed for tablets and smartphones, through which users can access car rental advertisements and use the services provided on the EraAuto website.

SUBJECT OF THE AGREEMENT AND SERVICES

Through this agreement, EraAuto provides Real and/or Legal Person Users, who will become members and use the website www.flamingo.ba and the EraAuto Mobile Application, with access to vehicles determined by third-party car rental companies with specific prices and features. It also classifies the data uploaded to EraAuto’s database by third-party car rental companies to allow users to find rental vehicles based on preferred dates, prices, locations, and features, and carries out various promotional activities. EraAuto also facilitates the rental of vehicles by Users from third-party car rental companies, collecting the rental fee (after deducting commission fees) and forwarding it to the third-party car rental company.

EraAuto acts as an intermediary between users and third-party car rental companies, offering the ability to rent vehicles through selected advertisements on the website. The User is required to pay the rental fee to EraAuto. As such, EraAuto acts as an intermediary between users and third-party rental parties. EraAuto may change, suspend, or terminate any content or service related to the advertisements or use of the site at its discretion, including modifying the commission added to the rental fee.

USER RIGHTS AND OBLIGATIONS The User declares, accepts, and undertakes that they have read the terms of this Agreement carefully, are over the age of 18, and have filled out the required information correctly and completely as requested during the membership process, and are bound by the terms of this Agreement from the moment they complete the membership process.

The Member User can register on the EraAuto e-commerce site by creating an account with their email address. It will not be possible to register with the same email address that has already been used.

3.1. USER RIGHTS

The User can access the site using the username and password sent to the email address provided during registration. As long as the payment obligations are fulfilled, the User has the right to enter into a car rental agreement with the parties owning the selected vehicle ads. The username and password will be activated after completing the initial registration process on the site. If the User wishes to continue purchasing services after the package usage expires, they can buy a new package and continue using the site with the same username and password. However, EraAuto grants users the right to use the content provided to them under the terms specified, but this does not grant the right to sell, share, publish, or transfer the services to others. The services are provided for a limited duration as outlined in the agreement.

3.2. USER'S OBLIGATIONS

The User hereby declares, accepts, and undertakes that they are obliged to carry out the following under this Agreement:

To fill out the membership form and provide a valid email address in order to use the services on the website.
To provide accurate information during the membership process, notify EraAuto immediately in case of any changes in the information, and update their information on the website.
After logging in with the username and password assigned to them, the services under this Agreement can be used by entering the password determined by the User, and the User is solely responsible for any failure to use the services due to incorrect entry of the username and/or password.
To take care to keep their password confidential and secure.
EraAuto shall not be held responsible for any damages arising from the use of the username and password by third parties.
To prevent inappropriate use in violation of this Agreement and/or immediately report such use to EraAuto.
To provide the necessary and sufficient internet access to benefit from EraAuto services.
To use a device that supports access to the website and applications.
To ensure the security of their connections and take the necessary precautions in this regard.
To pay the service fee via a payment method accepted by EraAuto.
To follow any changes in the terms of this Agreement and to terminate the membership if they do not accept the changes.
To not transfer their account to a third party and to use their membership personally.
To not copy, transfer, display, or use the content of the website in violation of this Agreement.
To not violate EraAuto's intellectual property rights.
To not infringe upon intellectual property rights such as copyright, patent, trademark, trade secret, or other ownership rights related to the provided content.
To not use or distribute viruses, worms, or similar harmful technologies that may harm the website or other Users.
To not use any data mining, data collection, or extraction methods.

The User confirms that all information provided during membership is correct, complete, and not fraudulent, and agrees to be fully responsible for any damages caused by false or incorrect information. The User also undertakes to compensate EraAuto for any damages the website may suffer as a result of fraudulent or incorrect information.

In order to ensure the timely delivery of the vehicle rental reservation services purchased from EraAuto's e-commerce site, the membership information must be provided accurately and completely. In case the membership information is incorrect or incomplete, EraAuto will not be held responsible if the delivery/fulfillment is not completed within the promised timeframe.

The User agrees and undertakes to take the necessary precautions to protect the confidentiality of their membership information and password. The legal responsibility for any misuse of the User’s password by third parties will belong entirely to the User. In case of damage caused by third parties or EraAuto due to the User’s failure to fulfill this obligation, all damages may be charged back to the User.

When making a vehicle rental request/reservation on the www.flamingo.ba and EraAuto mobile applications, the User will be deemed to have accepted the Car Rental Agreement prepared by the third-party car rental company acting as the operator/owner of the vehicle.
